U.S. Senator Al Franken — US Senator for Minnesota 1 hr · Minnesota seniors and families across our nation deserve quality long-term care. But right now, many nursing home contracts have fine print—known as forced arbitration clauses—that stack the deck against residents and their families who face a wide range of potential harms, including abuse, neglect, and even wrongful death. These clauses prevent many of our country’s most vulnerable individuals from seeking justice in a court of law, and instead funnel all types of legal claims into a privatized system that is often biased toward the nursing home. Last year, I was glad when the Centers for Medicare and Medicaid (CMS) heeded my call and banned these types of agreements in long-term care contracts. But now, the Trump Administration’s CMS has a proposal to scrap these protections for nursing home residents. I’m leading an effort with Senator Ron Wyden and 29 of our colleagues to urge CMS to abandon this reckless proposal because seniors and families all deserve to have somebody looking out for them in Washington. www.franken.senate.gov/?p=press_release&id=3750Sens. Franken, Wyden Lead Push to Stop Trump Administration From Ending Protections for Nursing Home Residents Senators Al Franken and Ron Wyden are leading a major effort to push the Trump Administration's Centers for Medicare and Medicaid Services (CMS) to abandon a proposal to scrap protections that prevent nursing homes and long-term care facilities from locking residents into forced arbitration agreemen... Rough night. Expect it is going to be a rough day. Thank you all for the well wishes. Surgery went well, and so did the first part of the night, but since about 2 when the nerve block wore off the pain meds are not strong enough. Hope the Dr makes rounds early, as must have something to control pain better. When you combine pain with angry Alzheimer's it is not a good thing. I know they are walking a thin line and she is not going to be pain free for quite awhile, but if it is a choice between advancing the Alzheimer's and being easy from the pain, I want to ease the pain. Nothing is going to cure the Alzheimer's.

Oh, Joyce, your poor Mom...I would choose better pain control too. As you said her Alzheimers is only going to get worse on its own, but the pain needs to be addressed. I can only imagine how exhausted you are today. Both physically & mentally. I would imagine your Dad is beside himself. Thinking of you.

Thank you for the hugs and well wishes. We had a much better night. She was pretty much knocked out all night. The pain med seems to finally be at the right dosage and they are also giving her xanax. Yesterday was bad, but hoping for a better day today. Have no idea what is going on in the world outside room 215 of this hospital.
